    Notes from Judge James Lincoln, 11/15/1999 after getting a copy of David Buchanan's will. ---- David Buchanan in his will, indicates that he left his wife in West Virginia and moved to Ashland, Ohio, in the latter part of his life. Maybe he wanted to be near son John Buchanan, father of Philura Buchanan Lincoln who would have been only 4 years old when David died in 1855. David was wealthy --- Board for Administration of will in Ohio - $30,000 security. His will had to be probated in Ashland County, Ohio and Washington County, PA, as he owned property in both states. Please note that David Buchanan left $1600 to his son, CUMMINS BUCHANAN. He must have been married to some one by the name of Cummins. Parents do not lay the first name of CUMMINS on a kid unless they have a CUMMINS in the family. CUMMINS BUCHANAN may be the only one of that name in the CUMMINS BUCHANAN history.

    R. C. Buchanan, a well known citizen of Hopewell township, was born in 1864 in Indedpendence township, this county. He is a grandson of David, whose father was Samuel Buchanan. The latter came with his wife and son, John, from Lancaster Co. PA, to Independence township, this county, in 1783, and on April 19,1785, purchased 300 acres of land on "Worley's Run" of Joseph Worley, who returned to the East. After settling in Independence township, three sons were born to Mr. and Mrs. Samuel Buchanan, namely: William, Samuel and David, all of whom remained in Independence township. John took the tract of 2xx acres (adjoining the farms of Henry Levens and John and Philip Doddridge) and died upon this farm; Samuel died about 1804 on the old homestead; William settled in Zanesville, Ohio, where he died. David Buchanan settled on a part of the old homestead on which he built a tannery in 1810, but on account of a fatal accident in which a son was drowned in the vat, he gave up the business in 1817. His son, David, afterwards inherited the old Buchanan farm, now occupied by John McAllister.

    LURA COOK'S NOTES-Birth date is noted as 1780 (instead of 1785); Death date is given as Dec. 6, 1855 (instead of April 6, 1855). I have not been able to confirm either date as of 3/11/2001.

    David Buchanan was born in Washington, PA, December 11, 1780. He married Jane Cummins (born August 17, 1788) of Virginia (now, West Virginia). The state line ran lenthwise of their porch. Part of her "setting out" was several Negro slaves. When the couple went to keeping house in Pennsylvania, she had to give them up.

    Robert Cummins, father of Jane, was a private in Captain Sam Hays Company, 7th Batallion, during the Revolutionary War. His record is in the Pennsylvania Archives, Series V, Volume 3. The 7th Batallion (or 7th Pennsylvania Regiment) was commanded by Colonel William Irvine.

    Revoltutionary War records certify that Robert's wife was Rebecca Jane Kilgore.

    The surname is sometimes spelled: Cumming and Cummins.

    DIFFERENT FACTS-- (From Judge James Lincoln) Robert Cummins never fought in the Samuel Hays Company. He fought in the Captain Robert Adams Company in the Revolutionary War. Source of this information is the Carnegie Library of Pittsburgh, 4400 Forbes Ave., Pittsburgh, PA, Pennsylvania Archives.

    "I have been unable to find in the Pennsylvania Archives a Robert Cummins in Samuel Hays' Company. I do find, the name, however, in Captain Robert Adams' Company. Photocopies are enclosed. Robert Cummins enlisted January 30, 1776.

    The DAR Lineage Book v. 111 also lists him in the Adams Company. Since Jane Kilgore, wife, is listed also in the family chart included in your letter I believe this is the right Robert Cummins. His name appears also in DAR Lineage Books v. 126, p. 277 with the information that he died near Bethany, W. Va.; v. 127, p. 148 gives his birthplace as Londonderry, Ireland."

    DAR Lineage Book V. 111, Nos. 110001-111000 - Robert Cummins (1751 - 1837) received a pension, 1832, for service as private, Capt. Robert Adams' Company, Pennsylvania Line. He was born in Londonderry, Ireland; died in West Virginia. ??Death date is given as 7-4-1837. The DAR doesn't have a manuscript file on Robert Cummins, just the name of the person who submitted DAR proof.

    NOTES based on the will of Robert Cummins, made by Judge James Lincoln (11/1999):
    Robert Cummins seemed to be a banker where there probably was no bank. Note that his estate was largely small loans he made that totaled over $2500 - which was a hell of a lot of money. Like many in that time, he deeded his land during his lifetime to his heirs - no gift tax then. (Gift taxes start at $10,000 today.) He gave his daughter, Jane Cummins Buchanan and husband David, slaves for wedding dower. He died near Bethany, West Virginia. (THERE WOULD BE RECORDS IN REGISTRAR OF DEEDS OFFICE OF BROOKE COUNTY, WV, AS TO LAND HE OWNED.)

    Burial site is right on the Pennsylvania and West Virginia state line, NE of Wheeling, just W of Washington, PA on Buffalo Creek. Burial ground belongs to Presbyterian Church Cemetery, Lower Buffalo, PA.

    Robert Cummings lived in what is now Independence township as early as 1792, if not before that time. On March 6th in that year he purchased 120 acres of land of William Spry. Again, Nov. 24, 1800, he bought 200 acres of Thomas Sheirer,part of a tract situated on the waters of Buffalo Creek, for which a warrent was issued Sept. 5, 1787 (=first purchase of this property from the new US Government.)
    It is not known upon which purchase Mr. Cummings resided, but the house liyed (sic. lied?) so exactly on the state line that one-half of his house was in Virginia and the other half in Pennsylvania. He built a grist-mill upon his property which became known as "Applegate Hill."

    Re: Warrants - were used in Pennsylvania as a way to get land from the King of England.
    There were four basic steps to get a warrant:

    1. Take the Oath of Fidelity to the King.

    2. The Warrant issued entitled the holder to have a described number of acres which had been surveryed. There were 3 different types of Warrants:
    1) Fee Simple (like owning land and you could hand land down to heirs)
    2) Fee Tail (could only hand down to lineal descent)
    3) Life Estate (just for your lifetime)

    4. The Grant is called a "Patent"

    There was no will for this Samuel Buchanan in Lancaster County.

    Hugh Kilgore, (2) the oldest child, was not a soldier in the Revolutionary War; at least no record of his service is to be found in the Pennsylvania Archives. In 1785 he witnessed the will of Thomas Ross, of Cumberland County. Following is an abstract of his (Hugh's) will:

    Hugh Kilgore, Tyrone Township, (now Perry County), Farmer, 5 April, 1805, "wife, Jean, daughter Rebecca. Sons; David and James, daughters Elizabeth Kelly, Mary Kilgore, Margaret and Jean. Executors, wife Jean and nephew, William McClure." Witnesses: Edward ___ , James Wilson. Signed, Hugh Kilgore,signed 5 April 1805, probated 23 April, 1805.
