    The evidence in this case reveals that on the evening of May 22, 1942, the deceased, Verne A. Hoar, and his son Edwin Hoar, eleven years of age, entered the automobile of Ralph O. Johnson at Wichita, Kan., about 7:30 o'clock, with the intention of going to California, where Mr. Johnson lived. The deceased was to share the expenses of the trip, and to pay $15 therefor. Other passengers were a Mr. Edwards, a brother-in-law of Mr. Johnson, and a sailor by the name of Barr. They were in a 1937 Ford Tudor, and Mr. Hoar and his son and Mr. Barr were in the back seat, and Mr. Edwards was in the front seat with Mr. Johnson, who was driving. They reached Liberal, Kan., about 2:30 in the morning on May 23, 1945 and stopped there for food and gasoline. At this time Mr. Johnson testified he examined his car and checked the lights, and found them in good condition. He was driving on his dimmers as was his practice. He was going in a southwesterly direction on U. S. Highway No. 54, and when about a quarter of a mile east of the town of Tyrone, in Texas county, he saw the lights of a car approaching from the opposite direction. He soon observed that the car was on his side of the road. As the car approached, he decided that driver of the truck was not going to yield the right of way. It had been raining and large bar ditches on each side of the road were filled with water. Acting in an emergency, he attempted to turn to the left, but before he could do so, the truck which was driven by defendant struck the side of his automobile, it was turned over twice, and

    demolished. Mr. Hoar was instantly killed, and his son, Edwin, severely injured. ...

    Jesse K. Hoar was born in Pennsylvania 21 September 1798; died in Fayette Co., Il 4 April. Jesse was reared among the Society of Friends and was taught early to love God and keep His commandments. At the age of 29, he married Mary Irwin who proved to be a faithful wife and helper. For 55 years they shared the joys and sorrows of life together. To them were born 11 children, 7 of whom still survive, one son in the ministry, Reverend B. A. Hoar, of the South Illinois Conference. When 30 years of age, he was united with the Methodist East Church and lived in her communion until God took him home. In 1844 he emigrated from Pennsylvania to Ohio and in 1856 to Illinois, where he remained until his death. To his aged companion and children, he left a priceless legacy--the example of a long and faithful Christian life. Jesse was a Quaker and Mary Ann a Presbyterian. They were both disowned by their churches because of their marriage. The couple subsequently joined the Methodist Episcopal Church.

    Mary I. Hoar, nee Irwin, was born in Lancaster County, PA, April 14, 1807. She died in the faith of the Gospel in Fulton County, Illinois November 24, 1891.
    Her parents were Presbyterian. At fourteen years of age she was converted and united with the Methodist Episcopal Church. For seventy years she lived a faithful consistent life, loved and esteemed by all.
    She was married to Jesse K. Hoar in her twenty-second year. Of this union were born four sons and seven daughters; three sons and six daughters lived to attain manhood and womanhood. The youngest son, Rev. B. A. Hoar, is a member of the Southern Illinois Conference. Sister Hoar lived to see forty-five grand children and twenty-five great grandchildren.
    She removed in 1844 from her native state to Knox County, Ohio, thence to Fulton County, Illinois, in 1856, thence to Fayette County in 1859. The home of Sister Hoar was always a hospital retreat for the itinerant. Prudent and careful with her neighbors, loving and kind to her family, her life has been a constant benediction. One of her sons said of her, "She never gave unholy council, nor said an unholy word in the presence of her family." The words of the wise man, Proverbs 31, Chapt. 10 - 31 verses are eminently true of this saint of God.
    She was buried in the cemetery at Cuba, Illinois, November 25. The funeral sermon was preached by the Rev.W. H. Whittock of the Central Illinois Conference. Full years and worn by time and care she was anxious to depart and be with Christ.
