    Robert Cummins, father of Jane, was a private in Captain Sam Hays Company, 7th Batallion, during the Revolutionary War. His record is in the Pennsylvania Archives, Series V, Volume 3. The 7th Batallion (or 7th Pennsylvania Regiment) was commanded by Colonel William Irvine.

    Revoltutionary War records certify that Robert's wife was Rebecca Jane Kilgore.

    The surname is sometimes spelled: Cumming and Cummins.

    DIFFERENT FACTS-- (From Judge James Lincoln) Robert Cummins never fought in the Samuel Hays Company. He fought in the Captain Robert Adams Company in the Revolutionary War. Source of this information is the Carnegie Library of Pittsburgh, 4400 Forbes Ave., Pittsburgh, PA, Pennsylvania Archives.

    "I have been unable to find in the Pennsylvania Archives a Robert Cummins in Samuel Hays' Company. I do find, the name, however, in Captain Robert Adams' Company. Photocopies are enclosed. Robert Cummins enlisted January 30, 1776.

    The DAR Lineage Book v. 111 also lists him in the Adams Company. Since Jane Kilgore, wife, is listed also in the family chart included in your letter I believe this is the right Robert Cummins. His name appears also in DAR Lineage Books v. 126, p. 277 with the information that he died near Bethany, W. Va.; v. 127, p. 148 gives his birthplace as Londonderry, Ireland."

    DAR Lineage Book V. 111, Nos. 110001-111000 - Robert Cummins (1751 - 1837) received a pension, 1832, for service as private, Capt. Robert Adams' Company, Pennsylvania Line. He was born in Londonderry, Ireland; died in West Virginia. ??Death date is given as 7-4-1837. The DAR doesn't have a manuscript file on Robert Cummins, just the name of the person who submitted DAR proof.

    NOTES based on the will of Robert Cummins, made by Judge James Lincoln (11/1999):
    Robert Cummins seemed to be a banker where there probably was no bank. Note that his estate was largely small loans he made that totaled over $2500 - which was a hell of a lot of money. Like many in that time, he deeded his land during his lifetime to his heirs - no gift tax then. (Gift taxes start at $10,000 today.) He gave his daughter, Jane Cummins Buchanan and husband David, slaves for wedding dower. He died near Bethany, West Virginia. (THERE WOULD BE RECORDS IN REGISTRAR OF DEEDS OFFICE OF BROOKE COUNTY, WV, AS TO LAND HE OWNED.)

    Burial site is right on the Pennsylvania and West Virginia state line, NE of Wheeling, just W of Washington, PA on Buffalo Creek. Burial ground belongs to Presbyterian Church Cemetery, Lower Buffalo, PA.

    Robert Cummings lived in what is now Independence township as early as 1792, if not before that time. On March 6th in that year he purchased 120 acres of land of William Spry. Again, Nov. 24, 1800, he bought 200 acres of Thomas Sheirer,part of a tract situated on the waters of Buffalo Creek, for which a warrent was issued Sept. 5, 1787 (=first purchase of this property from the new US Government.)
    It is not known upon which purchase Mr. Cummings resided, but the house liyed (sic. lied?) so exactly on the state line that one-half of his house was in Virginia and the other half in Pennsylvania. He built a grist-mill upon his property which became known as "Applegate Hill."

    Robert married Rebecca Jane Kilgore in 1783 in PA ?. Rebecca (daughter of Hugh Kilgore and Jean McClure) was born about 1760 in PA; died in 1834 in Lower Buffalo, Washington Co, PA. [Group Sheet]

    Hugh Kilgore, (2) the oldest child, was not a soldier in the Revolutionary War; at least no record of his service is to be found in the Pennsylvania Archives. In 1785 he witnessed the will of Thomas Ross, of Cumberland County. Following is an abstract of his (Hugh's) will:

    Hugh Kilgore, Tyrone Township, (now Perry County), Farmer, 5 April, 1805, "wife, Jean, daughter Rebecca. Sons; David and James, daughters Elizabeth Kelly, Mary Kilgore, Margaret and Jean. Executors, wife Jean and nephew, William McClure." Witnesses: Edward ___ , James Wilson. Signed, Hugh Kilgore,signed 5 April 1805, probated 23 April, 1805.

    James Kilgore was a highly honored and respected farmer; he was an ardent patriot and during the Revolutionary War, sent forth seven of his sons in the establishment of American independence. According to Egle's Notes and Queries, 3rd series, Vol. I, page 426 and Vol. II, page 159: James Kilgore died in 1781 (see note A below), leaving a wife Elisabeth (Betsy Jack), and the following children: Hugh, Benjamin, Joseph, Patrick, David, Mary, Oliver, Ezekial, John, Jonathon, William, Jesse and Robert. His wife Elizabeth, evidently died in 1792 as her will, made May 15, 1782, was probated February 14, 1792.

    Note A: James' will was dated in 1771. In the will, James' name is spelled Kilgoar.

    James Kilgore (1-A) was born about 1701 and died in 1777. Married Elizabeth Jack. About 1737 he moved from Chester Co., and settled in the Cumberland Valley, taking up land in Newton Township, Cumberland Co., PA.

    "In the name of God Amen. --- I will and allow unto my true and loving wife Elizabeth Kilgore, the whole use of my plantation-goods and chattels, implements of husbandry and household furnatur (furniture) while she remains my widow, for the paying of all my lawful debts, and for the bringing up and edicating (educating) my six youngest sons during there minority. But if she marries I allow her to leve (leave) the plantation, and give up all the above named goods and chattels, only one horse and bridle and saddle, with twenty one pounds and her little and big wheel and reel, one feather bed, with the clothing. And I will and allow that at the time of her marriage, or decease, that my executors herein after named, shall sell all my estate, real and personal that I am possessed of at the time of my decease, only the particulars above bequeathed and divid it in form and manor (manner) following:

    That is to say I will and bequeath unto my sons, Hugh, Benjamin, Joseph, Patrick, David, and to my daughter Mary, five shillings sarling (sterling) apiece. I likewise give and bequeath unto my son Oliver 5 pounds Pennasylvania currency, and all the rest I allow, and it is my will to be equally divided among my six youngest sons, Ezekiel, John, Jonathan, William, Jesse, Robert. But if any of the above named younger sons should turn prodigal, and not incline to work, but to weast (waste) the estate it is my will and I allow him or them to lows (lose) there (their) part, and it be given to the rest as above. But I allow none of the above named legatees to be paid until saile (sale) be made of the above named premises, or chattels. And further I do nominate and apoint (appoint) my true and loving brother Charles Kilgoar (Kilgore) and my dear and loving wife whole Executors of this my last will and testament hereby revoking and disannulling all former wills and testaments by me maid (made). And also this to be my last. In witness whereof I have here unto set my hand seal this 23rd day of August in the year of our Lord one thousand seven hundred and seventy one.

    Some five years after the death of John, his three sons moved from Chester County to Cumberland Valley taking up land in Newton Township, near what is now Newville, Cumberland, PA.

    Elizabeth (Betsy) Jack, who was the sister of Patrick Jack, one of the most remarkable characters of Pennsylvania, a hero of the Wilderness. Received a commission of Captain from the Governor of Pennsylvania. Jack's Mountain and Jack's Narrows along the Juniata were named for him. He offered his services to Braddock but was turned down.

    Elizabeth evidently died in 1792 as her will made May 14, 1782 was probated Feb. 14, 1792.
