In 1819, in the state of New York, Benjamin Hoar had his surname changed to Whitney along with his wife Abigail, their adult children Theophilus, Abel and Silence and their minor children Oliver, Polly and Abigail:

Whereas a petition has been presented to the Legislature of the
State of New York by Benjamin Hoar of the Town of Cambridge in
the county of Washington on behalf of himself and his wife
Abigail Hoar and his minor children Oliver Hoar, Polly Hoar, and
Abigail Hoar; and also by Theophilus Hoar, Abel Roar and Silence
Hoar the adult children of the said Benjamin Hoar all of the same
place praying that the name of the said Benjamin and his said
wife and children may be changed from that of Hoar to that of
Whitney Therefore
Be it enacted by the people of the State of New York represented
in Senate and Assembly that the names of the said Benjamin Hoar
and his wife Abigail Hoar and his said children Theophilus Hoar,
Abel Hoar Silence Hoar Oliver Hoar Polly Hoar and Abigail Hoar
shall be and the Same are hereby changed from that of Hoar to
that of Whitney and the said Benjamin Hoar and his said wife and
children and their descendants shall for ever be called and known
by the name of Whitney and shall sue and be sued pleas and be
impleaded by the name of Whitney and no other name until their
marriage with persons of other names shall render it otherwise by
the laws of this State. (State of New York) I certify the preceding to be a true copy of
Secretary's office) an original act of the Legislature of this State on file in this office.

I Benjamin Whitney solmnly swear and declare that I entered the revolutionary service solemnly the common enemy in the year of our Lord one thousand and seventy seven on the 15th day of May having enlisted for three years in a company commanded by Captain Samuel Darby of the town of Old York in the Province of Maine in the second Regiment of Infantry in the Massachusetts line. I enlisted by the name of Benjamin Hoar, which was then my name but has been altered by the Legislature of the state of New York on my application to Benjamin Whitney. The Regiment to which I belonged was commanded by Colonel Bailey. I remained for the whole term of my enlistment which was three years and was honorably discharged at West Point in the state of New York as my discharge will fully [show?] and that I am upwards of sixty years of age and by reason of reduced circumstances am under the necessity of claiming relief under the act to provide for certain persons engaged in the land any Naval service of the United States in the Revolutionary war and futher this desponent saith not.

On the 16th day of August 1820 personally appeared in open Court .....etc, Benjamin Whitney aged sixty two years resident of Salem in said County .... on his oath declare that he served in the Revolutionary War as follows in Colonel Bayleys regt. and in Capt. Luther Bayleys Company in the Massachusetts Line which was started in his original declaration dated the sixth day of May 1818 as appears by his pension certificate number 5266 And I do solemnly swear that I was a resident Citizen of the United States on the 18th day of March 1818 and that I have not since that time by gift sale or in any manner disposed of my property or any part thereof with intent thereby so to diminish it so as to bring myself within the provisions of Act of Congress intitled...... that I have not nor has any person in trust for me any property or securities contracts or debts due to me nor have I any income other than what is contained in the schedule hereto annexed and by me subscribed (First) part of a set of old shoemakers tools 4 old books an old gun and a jack knife And I do futhermore Swear that I am a Shoemaker, but am not able to labour but a little in consequence of continued torments in my right arm and want of sight and that I have no other in Family who depend on me for support.
